1. Acceptance of Terms

By accessing or using My Epic Resume ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

My Epic Resume provides an AI-powered interview service that generates professional career documents including resumes, CVs, cover letters, and professional profiles. The Service uses artificial intelligence to conduct interviews and create personalized documents based on your responses.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any information that becomes inaccurate
• Accept responsibility for all activities under your account

4. Payment and Refunds

Pricing: We offer multiple plans with varying access durations. All plans include the complete AI interview and document suite with unlimited use during the access period. Current pricing and tier details are available on our Pricing page. Prices are subject to change at any time without prior notice.

Payment: All payments are processed securely through Stripe. By making a purchase, you authorize us to charge your payment method.

Refunds: Due to the digital nature of our service, all sales are final once documents have been generated and downloaded. If you experience technical issues preventing you from receiving your documents, please contact us for assistance.

5. User Content

You retain ownership of the information you provide during the interview process. By using the Service, you grant us a limited license to:

• Use your information to generate your documents
• Store your information for the duration of your access period
• Process your information through our AI systems solely for the purpose of delivering the Service

Your data will not be used to train artificial intelligence models, machine learning systems, or any other automated learning technology. Processing of your information through our AI systems is performed exclusively for the purpose of generating your requested documents and delivering the Service.

You agree not to upload, submit, or otherwise make available any documents or content generated by the Service to any artificial intelligence training dataset, machine learning model, language model, or similar system. Documents generated by the Service are for your personal job search use only.

You are responsible for ensuring that the information you provide is accurate and does not violate any third-party rights.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Provide false or misleading information
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated systems, bots, scripts, or software to access the Service
• Scrape, crawl, spider, or use any automated means to extract data or content from the Service
• Access the Service via AI agents, autonomous bots, or large language model (LLM) integrations
• Engage in data mining, data harvesting, or systematic extraction of content
• Upload, submit, or feed any content from the Service to AI systems, machine learning models, or training datasets
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Overburden, impair, or disrupt our servers, networks, or infrastructure
• Resell, redistribute, or sublicense the documents generated or any content from the Service

7. Intellectual Property

The Service, including but not limited to its design, templates, algorithms, AI prompts, interview methodology, user interface, graphics, text, and all other content (excluding user-provided content), is owned by My Epic Resume and protected by intellectual property laws.

No content from the Service, including generated documents, page content, design elements, or any other material, may be used to train, fine-tune, or otherwise improve any artificial intelligence model, machine learning system, large language model, or similar technology. All platform content is expressly excluded from any AI training or data collection purpose.

Automated reproduction, extraction, or copying of any content from the Service is strictly prohibited, whether performed by human users or automated systems.

You may use the documents generated by the Service for your personal job search purposes only. This includes submitting documents to potential employers, recruiters, and job platforms. Any other use requires prior written consent from My Epic Resume.

8. Automated Access, Scraping & AI Restrictions

The following activities are strictly prohibited without prior written authorization from My Epic Resume:

• Web scraping, crawling, and spidering: Using any automated tool, script, or program to access, index, or collect data from the Service
• Automated tools: Using software such as Selenium, Puppeteer, Playwright, PhantomJS, HTTrack, or similar tools to interact with or extract content from the Service
• AI agents and bots: Accessing the Service through AI agents, autonomous bots, LLM tool-use interfaces, browser automation agents, or any non-human browsing method
• AI training and data collection: Uploading, feeding, or otherwise making any content from the Service available to artificial intelligence systems, machine learning models, training datasets, or data repositories used for AI development
• Data mining and extraction: Systematically collecting, harvesting, or extracting data, content, or metadata from the Service
• Circumventing technical measures: Bypassing or attempting to bypass any technical protection measures, rate limiting, access controls, CAPTCHAs, or other security mechanisms implemented by the Service

We implement rate limiting and other technical measures to enforce these restrictions. The Service is actively monitored for automated access patterns, and violating accounts or IP addresses may be blocked without notice.

Our robots.txt file is incorporated by reference into these Terms. Compliance with robots.txt directives does not constitute authorization to access the Service by automated means beyond what is expressly permitted therein.

9. Third-Party Services

The Service integrates with the following third-party providers to deliver its functionality. Your use of the Service is also subject to their respective terms:

• Stripe (Stripe API) — Payment processing. All payment transactions are handled securely by Stripe. See Stripe's Terms of Service.
• Google (Google OAuth) — Authentication. If you choose to sign in with Google, your authentication is handled by Google's identity services. See Google's Terms of Service.
• Google (Gemini API) — AI-powered document generation. Your interview responses may be processed through the Google Gemini API solely for the purpose of generating your documents.
• Anthropic (Claude API) — AI-powered document generation. Your interview responses may be processed through the Anthropic Claude API solely for the purpose of generating your documents. See Anthropic Consumer Terms of Service.
• Cohere (Cohere API) — AI-powered document generation. Your interview responses may be processed through the Cohere Cohere API solely for the purpose of generating your documents. See Cohere's Terms of Use.
• Meta (Llama API) — AI-powered document generation. Your interview responses may be processed through the Meta Llama API solely for the purpose of generating your documents. See Meta's Terms of Service.
• Mistral AI (La Plateforme) — AI-powered document generation. Your interview responses may be processed through the Mistral AI La Plateforme solely for the purpose of generating your documents. See Mistral AI's Terms of Service.
• OpenAI (OpenAI API) — AI-powered document generation. Your interview responses may be processed through the OpenAI OpenAI API solely for the purpose of generating your documents.
• xAI (Grok API) — AI-powered document generation. Your interview responses may be processed through the xAI Grok API solely for the purpose of generating your documents. See xAI's Terms of Service.

We are not responsible for the practices or policies of third-party service providers. We encourage you to review their terms and privacy policies.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that:

• The documents will result in job offers or interviews
• The Service will be uninterrupted or error-free
• The documents will be suitable for all purposes

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY EPIC RESUME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify, defend, and hold harmless My Epic Resume, its owners, operators, affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Any content or information you provide through the Service
• Unauthorized use of your account credentials

This indemnification obligation shall survive the termination of your account and these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles. Any legal action or proceeding not subject to arbitration under Section 14 shall be brought exclusively in the federal or state courts located in the State of Texas, and you consent to the personal jurisdiction of such courts.

14. Dispute Resolution

Informal Resolution: Before filing any formal dispute, you agree to first contact us at support@myepicresume.com and attempt to resolve the dispute informally for a period of at least thirty (30) days. Most concerns can be resolved quickly through informal communication.

Binding Arbitration: If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in the State of Texas. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

CLASS ACTION WAIVER: YOU AND MY EPIC RESUME AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

Exceptions: Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights. Either party may also bring claims in small claims court if the claim qualifies.

If for any reason arbitration is found to be inapplicable or unenforceable, you agree to submit to the exclusive jurisdiction of the federal or state courts located in the State of Texas.

15. Severability & Entire Agreement

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and My Epic Resume regarding the Service and supersede all prior agreements, communications, and proposals, whether oral or written.

Waiver: The failure of My Epic Resume to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by My Epic Resume.

Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. My Epic Resume may assign these Terms without restriction.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

17. Termination

We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Service and to access any and all data associated with your account will immediately cease.
